MADISON — Attorney General J.B. Van Hollen announced today that a Milwaukee county woman has been sentenced for a conviction of filing fraudulent insurance claims, a misdemeanor.
Doreen Hernandez, of 3101 East Adams Street in Cudahy, appeared in Waukesha County Circuit Court on October 28, and entered a guilty plea to three counts of fraudulent insurance claims. Today, sentence was withheld and Hernandez was placed on two years probation to include 45 days incarceration with Huber privileges and 50 hours of community service. She also must pay $19,146.11 restitution and a total of $1,096 in fines. As further condition of probation, Hernandez must maintain full-time employment or schooling and abstain from future misconduct.
According to the Department of Justice’s criminal complaint, Hernandez was employed as a Licensed Practical Nurse (LPN) participating in the Medicaid-based “Nurses in Independent Practice” program and was hired to provide in-home care to a seven-year-old boy with a number of health issues. Hernandez began caring for the boy in July 2009, but she proved to be unreliable and on October 19, 2009, the boy’s mother terminated the employment. In February 2010, the boy’s mother reviewed a report provided by the Medicaid program detailing the services that had been provided for her son. Doreen Hernandez was listed as having submitted claims showing she had actively provided services to the woman’s son through February 17, 2010. The amount of these false claims is $17,944.00.
