The News: A Milwaukee County judge granted a temporary restraining order blocking enforcement of Milwaukee’s 10:00 p.m. food truck curfew until at least June 10 after the Wisconsin Institute for Law & Liberty (WILL) challenged the ordinance on behalf of The Fatty Patty owner Abdallah Ismail.
The ordinance would have banned food trucks from operating after 10:00 p.m. downtown while allowing brick-and-mortar restaurants and bars to remain open. WILL argued the law violates the constitutional right to earn a living and equal protection under the law.
The Quote: WILL Associate Counsel, Kirsten Atanasoff, stated, “We are pleased the court granted emergency relief to protect Milwaukee’s small business owners from this unlawful ordinance. Food truck operators like Abdallah Ismail work hard to serve their communities and earn an honest living, and the City of Milwaukee cannot unfairly target them while allowing brick-and-mortar establishments to remain open. We look forward to making that case at the June 10th hearing.”
