SPOONER —Attorney General JB Van Hollen announced today that the Wisconsin Department of Justice has obtained a judgment against Michael D. Janey of Spooner, Wisconsin and his company, Auto Restore, Inc. for violations of the Wisconsin Motor Vehicle Repair Code, Wisconsin Admin. Code § ATCP 132.
The Consent Judgment resolves a Burnett County lawsuit filed by the State in November of last year. The complaint alleged defendants, who provide restoration and repair of vintage vehicles, violated multiple provisions of the Motor Vehicle Repair Code including failing to provide firm price quotations and estimates of repair completion dates; failing to provide notice of additional repairs; and, on at least one occasion, failing to return a customer’s motor vehicle where the customer declined to pay for unauthorized repairs.
Under the terms of the Consent Judgment, the defendants are required to pay the State of Wisconsin $90,000 to be used towards restitution and/or forfeitures and costs. In addition, defendants are required to comply with the Motor Vehicle Repair Code in the future and return the customer’s vehicle which the State contends was illegally held.
The case was investigated and referred to the Department of Justice by the Wisconsin Department of Agriculture, Trade and Consumer Protection. The case was prosecuted by Assistant Attorney General Nelle R. Rohlich. The judgment was entered by Circuit Court Judge James D. Babbitt.
