Court Rules Milwaukee’s Paid Sick Day Ordinance Unconstitutional

Washington, June 16, 2009 — Karen Harned, executive director, National Federation of Independent Business Small Business Legal Center, issued the following statement in response to the decision issued by Milwaukee’s County Circuit Judge Thomas Cooper that found the city’s paid sick day ordinance unconstitutional:

“This ordinance, if enforced, would have cost Milwaukee jobs. Small business owners and their employees need flexibility to negotiate what benefits work best for their businesses. Expensive mandates take away this needed flexibility and force employers to comply with burdensome paperwork requirements. Small business owners, who typically don’t have HR staffs, simply don’t have the resources available to comply with these types of ordinances.

“We are very pleased the court ruled in favor of small business and decided that Milwaukee’s paid sick day ordinance is unconstitutional.”
