AG Van Hollen: Announces judgment requiring Marathon County wood manufacturing operation to pay $35,000 in forfeitures, fees, and costs

MADISON — On September 17, 2012, the Marathon County Circuit Court entered a judgment against Marth Wood Shaving Supply, Inc., of Marathon, requiring it to pay $35,000 in forfeitures and mandatory court costs and surcharges for violations of its Wisconsin air pollution control permit.

According to the complaint, Marth Wood Shaving Supply’s air pollution control permit requires that wood fed into its dryers not contain more than 60% softwood fiber, by weight. For six of the seven months between September 2009 and March 2010, the average softwood fiber percentage of the wood Marth Wood Shaving Supply fed to its dryers exceeded 60%. Results of a stack test conducted April 3-7, 2010, showed that Marth Wood Shaving Supply exceeded the volatile organic compounds, particulate matter, and formaldehyde limitations contained within its air pollution control permit.

In addition, Marth Wood Shaving Supply failed to measure and record the pressure drop across process control devices, maintain pressure drops within the ranges specified in its malfunction prevention and abatement plan, monitor exhaust gas parameters, and timely submit its annual monitoring report and compliance certification report, all in violation of its air pollution control permit.

Marth Wood Shaving Supply has cooperated with the Wisconsin Department of Natural Resources to ensure future compliance with its air pollution control permit. As a result of the violations specified in the complaint, Marth Wood Shaving Supply sought a new permit better suited to its actual operations and curtailed its production until the new permit was issued.
