AG Van Hollen: Asbestos violations at a Fond du Lac renovation result in a $50,000 penalty

MADISON — Circuit Court Judge Richard Nuss has ordered Rolling Meadows Development, LLC, and Brian Fuchs to pay $50,000 in forfeitures and costs for violations of state laws regulating the proper handling of asbestos.

According to the complaint, filed by the Department of Justice (DOJ) at the request of the Department of Natural Resources (DNR), Rolling Meadows Development, LLC, and Brian Fuchs, doing business as Vanguard Contracting, committed a series of asbestos violations during the renovation of a former residence care facility to a hotel and conference center located at 1155 South Military Road in Fond du Lac. Rolling Meadows owned the property and hired Fuchs to renovate the site. The DNR investigation found that between November 18, 2009, and April 9, 2010, Fuchs and his employees, as part of the site’s renovation, demolished interior walls and disturbed asbestos-containing material (ACM) at the site without wetting it and without certified asbestos workers as required by Wisconsin law. In addition, the DNR did not receive the required notification of asbestos disturbing activity at the site prior to it occurring. The asbestos on site was subsequently properly remediated and disposed of.
