RESIDENTS FILE CLASS ACTION LAWSUIT AGAINST SANIMAX FOR FOUL ODORS

Liddle & Dubin, P.C., a nationally acclaimed environmental class action law firm, has joined with the Warshafsky Law Firm to file a class action lawsuit against Sanimax on behalf of residents living in proximity to the company’s Green Bay rendering plant.* The plant creates products from animal carcasses, a process known for emitting intense, offensive odors.

The complaint, filed in Dane County Circuit Court, alleges that the residential neighborhoods surrounding the rendering plant have been blanketed by offensive odors emitted from the Sanimax plant. As a result, area neighbors have been unable to enjoy the outdoor areas of their homes or open their windows. The foul odors generated by the rendering plant have deprived them of the full use and enjoyment of their properties.

The five Plaintiffs in the case seek to represent their neighbors in obtaining compensation for the odors they have endured. The Plaintiffs will ask the Court to certify the case as a class action, including all residents within a two mile radius of the facility.

“When the odor is present, you can’t stand to be outside and we can’t open our windows at night without waking up and gagging from the horrific smell,” Plaintiffs, the DeWindt family, noted. “Makes you feel like a prisoner in your home.”

The Sanimax facility in Green Bay has a well-publicized history of emitting odors in the surrounding area. County officials received about 50 complaints in 2012 with complaints continuing into 2013 and 2014.

“Animal rendering plants have the potential to produce some of the strongest foul odors of any type of industrial facility,” said Laura Sheets, an attorney with Liddle & Dubin, P.C. “This is especially true where the facility doesn’t take the proper precautions to protect their neighbors from odor emissions.”
