MADISON — Attorney General J.B. Van Hollen announced today that Dominic Lombardo of Madison was sentenced on one count of possession of heroin and one count of possession of drug paraphernalia. Lombardo had previously entered guilty pleas on those two counts, but his convictions were deferred and he was entered into the Dane County drug court treatment program. Lombardo was terminated from the program on May 15, 2014. Today, those judgments of convictions were entered, and Judge Stephen Ehlke withheld sentence and placed Lombardo on three years of probation on the possession of heroin charge. If Lombardo’s probation is revoked, he will return to Judge Ehlke for further sentencing.
According to the criminal complaint, Lombardo was in a vehicle with two other men on July 27, 2013. They had recently purchased and shared heroin when police had contact with the vehicle. All three men were arrested, and a small amount of heroin, various syringes, and other paraphernalia common in the consumption of heroin were found in the car. All three men implicated themselves in the drug activity.
On October 24, 2013, Lombardo entered a guilty plea on the possession of heroin charge. Two days later, he was found by police passed out behind the wheel of his car with a tourniquet around his arm and various syringes and other drug paraphernalia in the car next to him. Lombardo was charged with possession of drug paraphernalia for that incident. Judge Ehlke imposed costs as the sentence on that count.
Possession of heroin is a Class I felony punishable by a fine of not more than $10,000 or imprisonment for not more than three years and six months, or both. Possession of drug paraphernalia is a misdemeanor punishable by a fine of not more than $500 or up to 30 days in jail, or both.
